January 2025A number of important changes to the H-1B visa program are now effective. This visa program continues to be very popular for skilled tech workers from India for over two decades. Many of the CEOs at top tech companies arrived in America through this visa program.
Here are the areas where changes have been made:
1. H-1B Modernization Rule: Aimed at expanding the pool of specialized and high-skilled foreign workers, as well as international graduates of U.S. institutions, that American employers can hire.
2. Streamlined Application Process: The new rules will streamline the review and approval process to enhance efficiency.
3. Greater Focus on Employer Compliance: There will be increased monitoring of employers to ensure compliance with labor laws and regulations, aiming to protect U.S. workers.
4. Adjustments to Specialty Occupation Requirements: The rules clarify and potentially broaden the requirements for what constitutes a specialty occupation.
5. Changes in Petition and Cap Processes: Modifications in how petitions are submitted and processed may take place to better align with labor market conditions.

Application processing time will be faster: USCIS will now ensure faster processing of the H-1B extension applications.
Revising criteria for ‘specialty occupation’: The definition of a "specialty occupation" has changed. Previously, a degree will “normally” be required but will no longer be a mandatory prerequisite. This change allows a larger number of professionals with varying levels of skills to apply for the visa, provided their qualifications are relevant to their jobs.
Revamped Lottery Process: Under the new rules employers cannot submit bulk applications. This change is expected to provide more companies with an opportunity to acquire better talent.
Favorable to F-1 visa holders: F-1 visa holders, who are generally students, will now face less issues in transitioning to H-1B status.
Better compliance: From today, revamped Form I-129 will be compulsory for those applying for H1-B visas. This will help in improving compliance by the petitioners.
Overhauled Cap-Exempt Limit: Organizations doing research work will now qualify for cap exemption. Previously the definition was vague.
